francisco and about 60 in oakland. that's a look at weather. gianna, how's traffic? >> it's not too bad. we are starting to see a few break lights at the altamont pass westbound 580. eastbound 580 there is still roadwork in effect north greenville to north flynn at least one lane closed until with 11:00 today so expect delays on the eastbound side, as well. eastbound highway 4 at loveridge wrapping up in the next few minutes. right now all lanes still shut down for roadwork through there and better news along 101. we had three lanes completely shut down northbound near 92. that's now been cleared. we should get back up to speed within the next few minutes. accident blocking one lane still very early no delays as you work your way through there westbound 80 clear and in fact the eastshore freeway commute looks good. mass transit on time. bart under way with no delays. bart, ace, muni, caltrain and your ferries all no delays. there are street closures near folsom and essex. we are learning that the essex street ramp to the eastbound bay bridge connector is shut down. so we'll let you though w

person in critical condition, two others serious after a shooting in oakland near lake merritt around 10:30 last night. officers found a 50-year-old man shot outside a liquor store on east 18th street. according to police, it looks like he may have been an innocent bystander. they found three more victims a few blocks away. >>> san francisco police are trying to figure out who shot and killed a man in his 20s last night. officers found the man just before 8:00 near grove and buchanan streets. the man had been shot in the stomach and leg. he died at the hospital an hour later. >>> we just saw cate in berkeley. the dry spell is over. a lot of rain is coming in now. >> let's get the latest from cbs 5 meteorologist lawrence karnow. >> for a lot of folks it gets the blood pressure going again. this doesn't look as bad. still the rain in spots. it's dumping in some areas right now. you see on our high-def doppler radar, look at all the yellow off the coastline. that's going to be pushing onshore a little later on. this is not going to be as strong as that last series of storms. a closer look y
crimes increase around the stations in oakland and san francisco during the holiday season. last night bart oakland police private and volunteer security guards escorted passengers to their cars. bart will also increase security through the end of the month. >> i was ambushed by two men. they pointed a gun at me, asked -- took my stuff and pistol- whipped me in t face. >> most common is cell phone theft. police say riders should pay attention to their surroundings. >>> layoffs and red tape are causing oakland police to make fewer traffic stops down by 75% from a couple of years ago. officers have made fewer than 16,000 stops this year down from 68,000 back in 2009. police point to layoffs and staffing shortages that put lower priority items on the back burner. some officers also complain that the paperwork process is a deterrent because it is complicated and very time- consuming. >>> other bay area headlines on this friday now. frederick dozier is expected to be sentenced today. he was convicted last month for a series of sexual assaults in san francisco's mission district. the attack

this morning up the nimitz freeway through oakland. plus just getting word of what sounds like a pretty bad accident in daly city. we'll have details coming up. >>> good morning, everyone. it's tuesday, december 11. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. 5:01. we are on the scene of breaking news in the east bay at an apartment fire that started about an hour ago. cbs 5 reporter elissa harrington is in hayward getting the latest. >> reporter: that apartment completely destroyed and there was a mother who lived there with her young son. she told us that she thinks somebody threw something into her home and that's what caused it to set on fire. so arson investigators are on scene. they are trying to sort all of this out but we are on dixon street right by the bart station. this was a one-alarm fire but again it caused significant damage and firefighters say that that family won't be able to return home. nobody was hurt. pg&e crews also on scene securing some lines and we are still waiting to get some more information but as i said arson investigators are on scene. elissa h
now for a murderer after a 15-year-old girl was shot to death at an east oakland housing complex around 3:40 yesterday afternoon at 66th avenue and lion way. police say it appears the victim was walking with a group of people when a lone gunman approached them and opened fire. a 14-year-old boy was shot and his injuries are not life- threatening. witnesses say the shooter appeared to be between the angles of 13 and 16. -- between the ages of 13 and 16 bringing oakland's homicide number to 160 this year, 20% more than last year. san francisco has a third increase over 2011. san jose's 45 is relatively low for a city of its size up 12.5% from last year. >>> the numbers of drunk driving arrests and of fatal accidents are down this holiday weekend compared to last year. the chp reports on the first two days of the new year's weekend. the chp made 723 drunk driving arrests since friday night across the state, more than 200 fewer than last year. accidents killed nine people in california down from 12 in the sam period a year ago. local transit agencies are offering an alternative to dr
of a man accused of attacking an autistic girl from a group home in oakland. the 16-year-old victim walked away from the fred finch youth center last tuesday. federal law prevents staff members from stopping her. however they did follow her until she got in the area of the fruitvale bart station. that's where she disappeared she wasn't seen again for two days when a drive found her aboard a bun in san francisco. >> the bus driver had noticed that she had been beaten and was concerned about her. he could see that she was bruised and distraught and so he called 911. >> the suspect was arrested and could be charged today. >>> a search is on for a man who police say robbed a walgreens in palo alto. a surveillance camera captured images of the suspect here. police say he asked fortunate oxycontin and showed a pharmacist that he had a gun inside his back. the suspect is a white man in his 20s 6 feet tall short hair a white hat with a seattle seahawks logo on it. >>> the former head of contra costa county's narcotics unit will plead guilty this week to charges that he took confiscated drugs and o
outside. taking you toward the east bay you can see some of that there near berkeley and also near oakland but it's scattered and that's what we're going to see throughout the morning hours and tapering off this afternoon the still it is a wet and breezy start to the day. some of those winds 17 miles per hour into fairfield. out over the bay skies mostly cloudy, continuing to see some of those light showers at this time. the temperatures aren't too bad. mainly into the 50s outside but we have our own reporter out there right now, elissa harrington out there in the storm. how's it look out there right now? >> reporter: well, good morning. it's been raining on and off throughout morning. right now it's drizzling but traffic is moving smoothly as drivers head over the bay bridge, although it is very soggy out there. now, here's some video taken from last night and early this morning. people are of course breaking out the umbrellas and rain jackets. these showers will continue through the morning but should clear up by the afternoon. conditions on the bay bridge are wet with some large puddles

early this morning from san jose to oakland. officers began pursuing that car because it didn't have its headlights on. they finally used a spike strip to get the car to stop. that driver was arrested. officers say he will be charged with recklessly evading police officers. >>> former bart police officer johannes mehserle is expected back in court this morning trying to get his conviction overturned in the 2009 shooting death of oscar grant an unarmed man who had been detained by police. mehserle already served his two- year prison term for involuntary manslaughter. but he wants to clear his name. lawyers for grant's family will argue against the overturning of the conviction. >>> today the city council in redwood city will consider a makeover for the fox theatre. councilmembers are weighing a request from the owners for a tax break. in exchange, the owners will make a number of improvements to the historic building over the next 10 years. >>> a coast guard investigation into suspected smuggling near the channel islands off the santa barbara county coast has turned tragic. a small boat d
